What Komori Is

Komori Care is a wellness device. It is not a medical device. It is not FDA-cleared or approved to diagnose, treat, cure, or prevent any disease or medical condition. The data it provides is for informational and wellness purposes only.

No Diagnostic Claims

Komori surfaces data about your sleep patterns -- position, movement, temperature trends, sound events, and room environment. You interpret this data. We do not make claims about what any pattern means medically. Always consult your healthcare provider for medical decisions.

User-Defined Alerts Disclaimer

Alerts are based on patterns you define. They do not diagnose any medical condition. A "bed exit alert" tells you someone left the bed -- it does not tell you why. A "movement alert" tells you about motion patterns -- it does not diagnose seizures, falls, or any condition. Always follow your healthcare provider's guidance.

Insider Pass

The Insider Pass ($49) is non-refundable. It provides immediate access to the Sleep Position Analysis Toolkit, community access, founder updates, feature voting rights, and a $49 credit toward a future device purchase. It guarantees you Founder pricing when pre-orders open.

Pre-Orders (When Available)

When pre-orders open for the Founder Edition ($399) and Pioneer Edition ($799), they will be fully refundable before shipping. Shipping estimates are targets, not guarantees. Hardware development involves uncertainties and we will communicate any timeline changes openly.

Subscription

The optional cloud subscription is $99/year, auto-renewing. You can cancel anytime -- your device continues to work fully offline without a subscription. The subscription enables cloud sync, multi-device access, extended history, and wearable integrations.

Limitation of Liability

Komori Care, LLC provides this product and service on an "as is" basis. We are not liable for any decisions made based on data provided by the device. We are not liable for missed alerts, delayed notifications, or any consequences of relying on the device for safety monitoring. This is a wellness product and should not be your sole means of monitoring anyone's safety.

Arbitration & Class Action Waiver

Any dispute arising from or relating to these Terms, your use of Komori products, or any related matter shall be resolved through binding individual arbitration under the rules of the American Arbitration Association (AAA), rather than in court.

Class action waiver: You agree to waive your right to participate in a class action lawsuit or class-wide arbitration. All claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

Small claims exception: Either party may bring claims in small claims court if the dispute qualifies.

30-day opt-out: You may opt out of this arbitration agreement by sending written notice to legal@komoricare.com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

Subscription Auto-Renewal

Premium subscriptions auto-renew at the end of each billing period ($99/year or $9.99/month) unless cancelled before the renewal date. You can cancel anytime through your account settings or by contacting hello@komoricare.com. Cancellation takes effect at the end of the current billing period -- you will retain access to premium features until then.

We will notify you by email at least 14 days before any price increase takes effect, giving you time to cancel if you prefer not to continue at the new price.

Intellectual Property

All content, software, algorithms, signal processing techniques, and technology in Komori products are the intellectual property of Komori Care, LLC. Patent pending.

You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of any Komori software or firmware, except as expressly permitted by applicable law. You may not copy, modify, distribute, or create derivative works based on Komori's proprietary technology.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Virginia.

Changes to Terms

We may update these terms as the product evolves. We will notify you of significant changes by email. Continued use of the product after changes constitutes acceptance of the updated terms.
